Why Florida residence matters

Spanish-law eligibility and Miami consular logistics are different questions

The Consulate General of Spain in Miami serves Florida, Georgia and South Carolina. Its consular district includes Miami-Dade, Palm Beach and Broward residents. The competent Spanish office and exact application category, rather than proximity to Miami alone, determine which current instructions apply. See its official consular district.

Florida is your U.S. state of residence, not a Spanish immigration route. This page explains official local processes; our Visa & Residency and Spanish Nationality service pages address eligibility, evidence strategy and the Spanish-law legal engagement.

Consular intake: category by category

Where does a Florida resident submit a Spanish visa application?

Miami's published official filing-channel notice distinguishes in-person application-center appointments from tracked postal filing for certain visa categories. These are administrative receiving instructions; legal requirements and exceptions must be verified for the exact visa.

Non-Lucrative Visa and retirement

At the review date, Miami directs non-lucrative residence applications to an in-person BLS Miami appointment, with filing by the applicant or a duly accredited representative where the official notice permits it. Separate applicant-only steps may still apply. A Florida retirement or investment portfolio does not itself establish Spanish legal eligibility.

Schengen and study visas

The same Miami notice lists ordinary short-stay applications and specified study visa categories for BLS intake. Do not assume a U.S. passport holder needs a short-stay visa, or that a consular application-center instruction confers legal representation rights for every act.

Family of a Spanish citizen

For the named residence-visa route for family members of Spanish nationals, the Miami publication currently identifies tracked postal submission to the consulate. Distinguish this route from other family and EU free-movement categories before assembling the file.

Other long-stay categories

For several other residence categories, including international telework, Miami's notice currently specifies tracked postal filing to the consulate. The latest consular procedure-specific instructions prevail, including any personal appearance or originals that may be requested.

BLS is an application center for assigned intake; it does not decide a Spanish visa. A lawyer can assist with Spanish-law preparation within the agreed scope. Personal attendance cannot be waived unless the competent procedure allows it.

Authentication of U.S. documents

Florida apostille or federal FBI apostille?

Florida public records

The Florida Department of State handles apostilles for qualifying Florida public records. A properly certified Florida birth or marriage certificate is not interchangeable with an ordinary photocopy.

Certified copies and translation

Check the Florida accepted-document rules. A Florida notary's ordinary copy certification cannot replace an eligible government-issued vital record. Spanish translation and original-document requirements depend on the specific authority and procedure.

For federal criminal history, see our dedicated FBI Background Check & Apostille guide.

Civil Registry and Spanish nationality

Conservation and recovery can require personal declarations

Spanish nationality conservation, loss and recovery depend on the facts and the applicable Spanish Civil Code, Articles 24–26. The Miami Civil Registry publishes procedure-specific document review and appointment instructions.

For nationality conservation and recovery, the consulate may require advance submission of documents through its designated channel and the applicant's personal attendance for the relevant declaration. Representation for legal advice or document preparation is not a substitute for such personal acts. Passport renewal is not automatically the same as a nationality determination.

Frequently asked questions for Florida residents

Which Spanish consulate serves Florida?

The Consulate General of Spain in Miami serves residents of Florida, Georgia and South Carolina. Check the particular procedure before arranging a consular appointment.

Does the Miami Non-Lucrative Visa require a BLS appointment?

The Miami consulate currently directs NLV filing to an in-person BLS appointment and permits a duly accredited representative for submission. Any separate applicant-only step remains subject to applicable instructions.

Can the Florida Department of State apostille my FBI report?

No. FBI records are federal. When needed for a Spanish procedure, their apostille is handled through the U.S. Department of State.

Can a lawyer appear for my Spanish nationality declaration?

Not for a legally personal declaration. A lawyer may help prepare Spanish-law arguments and documents, but Miami's stated personal-appearance requirements must be respected.
