Spanish Residency to Citizenship: How to Obtain a Spanish & EU Passport

For Americans planning a long-term future in Spain, the important question is not simply which visa to obtain. It is whether a lawful residence strategy can eventually meet the specific requirements for Spanish nationality—and when it cannot.

Can Americans become Spanish citizens?

Yes, in qualifying cases. U.S. citizens may apply for Spanish nationality if they meet a statutory acquisition route. For nationality by residence, Article 22 of the Spanish Civil Code generally requires 10 years of lawful, continuous residence immediately before filing, with defined 5-, 2- and 1-year exceptions. Those figures are thresholds for applying, not a promise of approval or a passport on that anniversary.

Critical boundary: A visa, a residence card, an EU long-term resident permit, years spent in Spain or a home purchase never automatically confer Spanish nationality. This guide is general Spanish-law information, not individualized eligibility confirmation.

Not every pathway runs in this order: nationality by origin, option or recovery can follow different rules and may not require prior Spanish residence.

These are distinct legal statuses. The EU long-term resident designation is particularly easy to misunderstand.

Spanish long-term statuses are governed by Royal Decree 1155/2024, notably Articles 175–183; the EU status also derives from Directive 2003/109/EC. Rules for eligible residence time and absences differ from nationality rules. Do not transfer an absence threshold from one regime into another.

Which Spanish residency route should you choose?

A viable plan starts with your real financial means, employment location, family situation, immigration history and intended presence in Spain. The most popular label is not necessarily the lawful fit.

How many years does it take to obtain Spanish citizenship?

Article 22 of the Civil Code provides different pre-application qualifying residence periods. The applicant must also demonstrate good civic conduct and sufficient integration. An administration's resolution and the later Civil Registry steps are additional stages.

Who can qualify for the one-year period?

Article 22(2) includes a person born in Spanish territory; a person who did not timely exercise an option; persons under qualifying Spanish guardianship, custody or foster care for two consecutive years; a person married to a Spanish citizen for one year at filing and not legally or factually separated; the surviving spouse of a Spanish national where there was no separation at death; and persons born outside Spain to a parent or grandparent who was originally Spanish. The particular legal conditions and proof for each category must be assessed.

Marriage or ancestry does not erase the separate one-year qualifying residence requirement for this residence-based route. Nationality by origin or option may be a different route altogether.

Born in Latin America, now a U.S. citizen?

The two-year provision turns on qualifying nationality of origin, not a generic label such as “Hispanic,” having Spanish-speaking relatives or possessing a U.S. passport. If you were born with an Ibero-American nationality and later naturalized in the United States, the analysis must establish your origin status and how subsequent nationality events affect your current legal situation. A birth certificate alone may not settle current nationality or eligibility. Multiple citizenships require document-level review.

Residency clock: the decisive evidence

Article 22(3) requires legal, continuous residence immediately before the application. Tourist visits, simply owning a property, municipal registration alone or ordinary study stay cannot be treated as qualifying residence without establishing the exact legal status. Review authorization dates, renewals, actual residence and travel/absence records. There is no single universally safe absence allowance for Spanish nationality that can be copied from the long-term-residence rules; authorities assess continuity against the facts and applicable law.

How the Spanish citizenship application works

  1. 1. Confirm the correct statutory route and residence history

    Check Article 22 category, continuity, identity, residence authorizations, travel history and whether nationality by origin, option or recovery may be more appropriate.

  2. 2. Assemble personal records and background evidence

    Typical evidence includes valid identity and residence documents, a birth certificate, required criminal-record certificates, and route-specific family or nationality documents. Foreign public records may need apostille or legalization and official Spanish translation. Requirements vary with provenance, treaties and exemptions.

  3. 3. Satisfy applicable integration and examination requirements

    Ordinarily adults must address CCSE (constitutional and sociocultural knowledge) and DELE Spanish-language competence at A2 or higher. A DELE exemption may apply to qualifying nationals of origin of Spanish-speaking countries and other statutory categories; dispensations/accommodations are separate. Do not assume an exemption from both exams because you speak Spanish.

  4. 4. Submit, monitor and respond

    The Ministry of Justice's nationality-by-residence procedure supports electronic filing, including properly documented representation. Check fees, authenticity and notification access; answer requests for additional evidence within applicable deadlines. A filing confirmation is not a grant.

  5. 5. After approval, complete acquisition steps

    Observe the legally applicable deadline for an oath or promise of allegiance, any required declaration regarding previous nationality, and Civil Registry inscription. The ordinary post-notification window to complete required Article 23 steps is 180 days; check the resolution, competent Civil Registry and any applicable special rules.

  6. 6. Apply for your DNI and Spanish passport

    After the nationality has been validly acquired and registered, follow the identity-document procedures of the competent Spanish authority. A passport application is not interchangeable with a pending nationality application.

The Ministry of Justice and the Spanish Civil Registry, rather than BLS New York, control nationality-by-residence procedure. Some consular Civil Registry acts are available abroad for other nationality routes; local competences should never be generalized.

Can Americans have dual U.S. and Spanish citizenship?

Analyze both countries separately. The U.S. Department of State explains that U.S. law generally permits U.S. citizens to obtain foreign nationality without requiring a choice, and loss of U.S. nationality involves a voluntary expatriating act and intent to relinquish U.S. citizenship. U.S. dual nationals must enter and depart the United States using a U.S. passport.

Spain's Civil Code Article 23 generally requires a declaration renouncing previous nationality for certain modes of acquisition, subject to the statutory exceptions (including qualifying nationals of Ibero-American countries, Andorra, the Philippines, Equatorial Guinea, Portugal, and other legislatively specified cases). A U.S.-only applicant should not presume an exemption. The Spanish declaration and formal renunciation of U.S. nationality before U.S. authorities are legally distinct processes.

Important: Neither “everyone can retain both” nor “Spain automatically cancels a U.S. passport” is sound advice. Establish all nationalities and acquisition histories, Article 23 exceptions and potential later Spanish nationality-loss rules before filing; obtain independent U.S.-law advice if needed.

What does a Spanish passport—and EU citizenship—actually offer?

Once a person legally acquires Spanish nationality, they also become a citizen of the European Union. EU citizenship carries mobility and residence rights under EU law, including the right to move to and work in other Member States subject to conditions and administrative formalities. Travel documentation, family rules, public-service access and social benefits can carry specific requirements.

Spanish citizenship is not a tax exemption, a guarantee of all benefits in every country, or unrestricted residence in non-EU states. Spanish and U.S. tax residence, reporting and financial planning should be addressed independently with qualified tax professionals.

Nationality of origin

A Spanish parent or qualifying circumstances under Article 17 may mean nationality existed at birth; documentation/registration may be the real issue.

Nationality by option

Article 20 provides defined eligibility categories and different timing/personal declaration rules; a family link alone does not establish a current option.

Recovery

Former Spanish nationals may consider the Article 26 route; residence, declarations and exceptions require a separate analysis.

Frequently asked questions

Can an American become a Spanish citizen?

Yes, if a specific Spanish-law nationality route and all its requirements apply. Being a U.S. citizen alone does not create entitlement to Spanish nationality.

Does buying a house in Spain lead to citizenship?

No. Ownership does not grant legal residence or nationality, and Spain closed its Golden Visa route to new investor applications in April 2025.

Is Spanish citizenship possible after two years?

The two-year residence threshold is available to qualifying nationals of origin of specified countries and to Sephardic applicants under Article 22. It is not available to every U.S. passport holder, and two years is not a guaranteed decision or passport timeline.

What if I was born in Latin America and later became a U.S. citizen?

The exact nationality-of-origin evidence, current legal nationality or nationalities, and any loss or retention of origin nationality must be examined. Birthplace alone does not resolve eligibility for the two-year rule.

Does a student visa count toward the citizenship residence period?

Ordinary authorization of stay for studies is legally distinct from qualifying residence; do not assume study time counts as nationality residence. Check the exact permit history and any later change of status.

Can I get an EU passport through Spanish permanent residence?

No. Long-term Spanish residence and EU long-term resident status remain immigration statuses for non-EU nationals. EU citizenship follows Spanish nationality, not permanent residence alone.

Does marriage to a Spanish citizen give immediate citizenship?

No. A spouse generally still needs at least one year of qualifying legal residence, one year of marriage at application, no separation, and all remaining Article 22 requirements.

Can I hold American and Spanish nationality?

U.S. and Spanish rules must be assessed separately. U.S. law does not generally require automatic loss upon foreign naturalization, but Spanish acquisition may require a declaration of renunciation unless an exception applies. A Spanish declaration is not the same procedure as formal expatriation under U.S. law.

How long does a Spanish citizenship application take?

The residence thresholds govern eligibility to apply. Administrative review, decisions, post-grant declarations, Civil Registry registration and passport issuance add separate, variable time.

Can a New York consulate grant nationality by residence?

Nationality by residence is handled through Spain's competent Ministry and Civil Registry processes. Consular Civil Registry procedures for option, recovery or other matters are separate and depend on the specific route.
