FBI Background Check & Apostille for a Spain Visa | U.S. Applicants

Many Spanish national-visa and residence procedures require U.S. applicants to document criminal-record history. For U.S. records, current New York Consulate instructions for multiple categories specify FBI-issued records and reject local or state police checks. The FBI result, federal apostille and Spanish translation are separate steps that must be coordinated with the requirements of the specific visa.

Do I need an FBI background check for a Spain visa?

It depends on the visa or residence category, the applicant's age, the duration of the stay and residence history. Current New York instructions for several national-visa categories require a criminal-record certificate and state that, for the United States, FBI-issued records are accepted while local and state police checks are not.

Do not order documents from a generic checklist. First identify the Spanish route and the period of criminal-history evidence it requires. Requirements differ across categories and can change.

An FBI background check is a federal document. When an apostille is required for use in Spain, the apostille is obtained through the U.S. Department of State.

Who issues the apostille for an FBI background check?

The FBI does not issue the Hague Apostille. The FBI authenticates its fingerprint search results with its watermark and an official signature. A requester who needs an apostille can then submit the authenticated federal document to the U.S. Department of State Office of Authentications.

Because the FBI record is federal, this is different from the state-level authentication process that may apply to state-issued documents.

Common mistakes we look for before a Spain filing

  • Using a local or state police check when the applicable New York Consulate instructions require an FBI-issued record.
  • Ordering the record too early and discovering that it falls outside the permitted validity window at filing.
  • Missing residence-history requirements when the Spanish procedure asks for records from more than one country of residence.
  • Treating authentication, apostille and translation as one step. They perform different functions.
  • Assuming every Spain visa has the same criminal-record rule. The selected route controls.

What if fingerprints cannot be captured or the FBI cannot produce the expected result?

Do not substitute a local or state police certificate on your own when the Spanish procedure calls for an FBI record. If repeated fingerprint attempts or another documented problem prevents the expected FBI result, preserve the FBI documentation and obtain case-specific guidance before filing.
