Moving to Spain from the USA | Spanish Legal Guidance for Americans
Americans can move to Spain, but the legal route depends on what you plan to do there: retire or live without working, work remotely, study, join family, start a business or take qualifying employment. Spain Law NYC helps U.S.-based clients identify the correct Spanish route before they spend time and money building the wrong file.

Can a U.S. citizen move to Spain?
Yes. U.S. citizenship does not by itself give a right to reside long-term in Spain, so an American planning to live there generally needs a Spanish immigration status that matches the purpose of the move. The correct route should be identified before treating a visa checklist as universal.
Start with the activity, not the visa name. Whether you will work, telework, study, live from savings or pension income, accompany family, invest in a business or accept qualifying employment changes the legal analysis.
Which Spain route fits your move?
These are starting points, not automatic eligibility determinations. Each route has its own evidence, filing channel and legal requirements.
Living in Spain without working
Assess the Non-Lucrative Visa if the plan is residence without gainful employment or professional activity.
Working remotely from Spain
Assess Spain's international telework / Digital Nomad framework if qualifying remote work is central to the move.
Retiring in Spain
Retirement is an objective, not the formal name of a Spanish visa. Retirees commonly assess the NLV when they will not work.
Studying in Spain
Study and training routes have category-specific requirements and filing rules.
Joining Spanish or EU family
Family of Spanish citizens and EU-family free-movement residence are distinct frameworks that depend on the facts.
Business or qualifying employment
Entrepreneur, self-employment, HQP, EU Blue Card and ICT routes belong to Spain's business-immigration framework.
USA to Spain: a practical legal sequence
1. Define what you will do in Spain
Residence, work, remote work, study and family circumstances determine which legal framework should be tested.
2. Confirm the competent procedure
Your residence and visa category affect jurisdiction, filing channel, personal-attendance requirements and whether representation is permitted.
3. Build the U.S. document file
Depending on the route, the file may involve civil records, criminal-record evidence, financial or employment evidence, insurance, medical documentation, apostilles and official translations.
4. Plan housing separately from immigration
Renting or buying can be part of relocation planning, but purchasing Spanish property does not by itself create a right to reside in Spain.
5. Review cross-border tax exposure before the move
Immigration status and tax status are separate questions. Spain Law NYC coordinates Spanish-law issues; individualized tax advice and filings are handled by independent qualified tax professionals.
6. Complete Spain-side formalities
After approval and entry, the required steps depend on the authorization and circumstances and can include immigration-card, registration and administrative formalities.
